Hey guys,

As I am currently living in the dorm at my college (damn bay area housing prices), I'm living under a gun ban. Here's exactly what my lease says:
"...The following activities are prohibited...

F) Use and/or possession of firearms, weapons, hunting arrows, or potentially injurious war souvenirs"

Strange wording aside (no injurious war souvenirs?), is this legal? I know it's the bay area, but I've spoken to the chief of police and he's told me there are no special weapon bans in Fremont, or any county law that regulate gun ownership. Can my landlord actually legally prohibit me from owning a firearm?

Its their building. Private employers can make it illegal to carry a firearm into their buildings - landlords can probably do the same with the rationale being "Don't like it? Leave."

I'm not saying I agree with it, but that's the way it is. Get over to www.shotgunworld.com (a sister site to pistol world) and do some browsing through the various forums. There were a whole bunch of threads started on this sort of subject around the time of the V-tech shootings. Lots of information and debate that a don't care to rehash.

A lot of colleges had stuff like this prior to the VT stuff. A buddy of mine had to leave his shotgun with the campus police and check it in and out everytime he wanted to go to the range. As stated earlier, it's their property, their rules. A lot of stores have stickers on their front doors that state NO CONCEALED WEAPONS. Ya gotta abide by their rules or not frequent them.

And be careful to read it over and talk with your RA if you have *any* "gray" items, such as replicas, airsoft, pellet guns...a college I went to for a year forced someone to store off-campus a factory cut-away Glock, one of those training models so you can see all the moving parts but isn't a functioning gun. People are *very* nervous in college about this sort of thing. We wouldn't want you getting evicted and stuck paying Bay Area rent (and boy do I know what that looks like...)

One thing the law sides with is university campuses. Seeing that it is an institute of education, they can mandate it that on their property, no guns allowed.

But seeing that it's an institute of HIGHER learning, they can also choose to allow guns on campus. Some colleges do, mine didn't.

Landlords can't prohibit you owning a firearm, because when you are on a lease for property, it becomes your property for that year. Which is why the landlord can't come over unannounced, as well as tell you what you can and can't have inside your place.

Dorms are a different area, because everything belongs to the school. Even though you live there for the year, you're just living on their property, it all belongs to the school, not you for that time period.

So they F you like that. Your best bet would be to talk to the cops on campus, because you might just have to store your guns with them, and check them in and out when you want to go shooting.

Sucks, but that's how it is.
